Eligibility

Who Can Buy Property in India

Under FEMA (Foreign Exchange Management Act) regulations, most NRIs and OCIs can freely buy residential and commercial property in India — with a few notable exceptions.

  • NRIs (Non-Resident Indians holding an Indian passport)
  • OCI (Overseas Citizen of India) cardholders
  • PIO (Person of Indian Origin) cardholders, subject to current rules
  • Purchase of residential and commercial property
  • Joint ownership with resident Indian relatives

  • Purchase of agricultural land, farmhouses, or plantation property
  • Foreign nationals of non-Indian origin (separate rules apply)

Documentation Checklist

Having these ready in advance is the single biggest thing that speeds up an NRI transaction.

Banking & Repatriation

Moving Money In — and Eventually Out

NRE Account

Holds foreign earnings converted to INR. Both principal and interest are freely repatriable, making it the common choice for funding a property purchase.

NRO Account

Holds income earned within India (rent, sale proceeds). Repatriation is permitted up to prescribed annual limits, subject to tax clearance certificates.

Repatriating Sale Proceeds

Proceeds from selling a property can generally be repatriated up to the original investment amount, for up to two residential properties, subject to RBI conditions.

Note: Repatriation limits, required certificates (like Form 15CA/15CB), and account rules are set by the RBI and Income Tax Department and are revised from time to time. Please confirm current limits and paperwork with your bank and a chartered accountant before relying on these figures.
